Attendance and Punctuality Policy

American Personnel and Temps bases its business on our ability to match dependable qualified associates to our valued clients needs. In order for us to serve both you and our client companies, we have initiated an Employee Agreement.

American Personnel and Temps requires good attendance while you are on assignment. Unsatisfactory situations include:

  • Tardiness
  • Leaving work early
  • Absences
  • No shows
  • Extended breaks and lunches

The following are our procedures to prevent any misunderstandings:

  1. If you cannot accept the conditions (hours, pay, location, length of assignment, etc.) of an assignment being offered to you, please do not accept the assignment.
  2. Upon committing to an assignment, the following conditions must be adhered to for the continued employment:

A. If an assignment cannot be completed, a 48-hour working notice must be given to your American Personnel and Temps Representative in person or over the phone. This will allow us adequate time to line up a replacement for you.

B. You must obtain prior permission from your American Personnel and Temps supervisor to leave an assignment early, to arrive late, or to take an extended lunch break.

C. Your American Personnel and Temps Representative must be notified of any pre-scheduled job interviews, appointments or vacation days prior to accepting any job assignment.

Failure to adhere to any of these procedures would be grounds for termination with American Personnel and Temps. We appreciate your cooperation with these conditions, and we look forward to a long and productive relationship with you as we assist you in meeting your employment objectives.

Texas Fire Arm Policy

Firearms are forbidden in or near our client's locations or any American Personnel and Temps branch office. I agree that as an associate of American Personnel and Temps, I will never bring any firearm in or near a client location or any American Personnel and Temps branch office. Any breach of this policy will result in disciplinary action and/or termination.

Safety Policy

American Personnel and Temps has developed these safety rules patterned after the Federal OSHA requirements. Read and become familiar with these rules and other safety rules that apply to your job.

1. Report an injury to your client supervisor and American Personnel and Temps supervisor immediately.

2. Report any observed unsafe condition to both your client supervisor and to American Personnel and Temps.

3. Horseplay is prohibited at all times.

4. The use of illegal drugs or alcohol is not permitted on the job.

5. Do not carry anything that is bigger or heavier than you can manage. Ask for help if you need it. Employ team lifting in order to lift safely.

6. If you do not have current First Aid training, do not move or treat an injured person unless there exists the hazard of falling objects, in which case, wear a hard hat.

7. Appropriate clothing and footwear must be worn on the job at all times.

8. Do not perform any task unless you are trained to do so and are aware of the hazards associated with that task.

9. If assigned any personal protective safety equipment, this equipment must be worn when required and maintained in good condition.

10. Learn safe work practices. When in doubt about performing a task safely, contact your supervisor for instruction and training.

11. Never remove or bypass safety devices.

12. Do not approach operating machinery from the blind side; let the operator see you.

13. Learn where fire extinguishers and first aid kits are located.

14. Maintain a general condition of good housekeeping in all work areas at all times.

15. Be alert to hazards that could affect you and your co-employees.

16. Obey safety signs and tags.

17. Always perform your assigned task in a safe and proper manner; do not take shortcuts. The taking of shortcuts and the ignoring of established safety rules is a leading cause of employee injury.

Be assured that in the event of a legitimate injury requiring medical care, American Personnel and Temps will ensure that you receive prompt and immediate medical attention as soon as the accident/injury is reported. We care about your well-being and safety on the job as well as your full recovery from any accidents or injuries.

However, pleased be advised that American Personnel and Temps is an extremely proactive company when it comes to accidents. We will fully investigate each and every injury that requires medical treatment and if fraud is discovered, we will prosecute it to the fullest extent of the law. WORKERS COMPENSATION FRAUD IS A FELONY THAT WE WILL NOT TOLERATE.

I also understand that any injuries I report will be fully investigated by American Personnel and Temps representative. Failure to abide by the safety rules listed in this document may be grounds for termination and may disqualify my insurance benefits.

Substance Abuse Policy and Drug Screen Consent

The policy of American Personnel and Temps is to maintain a drug and alcohol free work environment that is safe and productive for our employees and our clients. To meet these objectives, the following policy has been adopted:

The unlawful use, possession, purchase, sale, distribution or being under the influence of any illegal drug and/or the misuse of legal drugs while on American Personnel and Temps or client premises or while performing services for American Personnel and Temps or our client is strictly prohibited. American Personnel and Temps also prohibits reporting to work or performing services while impaired by the use of alcohol or consuming while on duty.

In order to ensure compliance with this policy, substance abuse screening may be conducted in the following situations:

Pre-employment: As may be required/requested by American Personnel and Temps or clients

For Cause: Upon reasonable cause to believe that a substance abuse problem exists

Random: Unannounced random selection of employees may be performed

Post Accident: Any employee involved in an accident/injury while performing services for American Personnel and Temps or client that results in property damage or bodily injury requiring medical treatment will be required to submit to a substance abuse screening.

Compliance with this policy is a condition of employment. Employees who test positive or who refuse to submit to substance abuse screening will be subject to termination.This policy will be enforced at all times in accordance with applicable state law.

I hereby give American Personnel and Temps permission to have their medical company physician send my specimen to a laboratory for a screening test for the presence of illegal drugs, alcohol, or prescription medication taken without a prescription at any time before or during my employment with American Personnel and Temps. I will hold all parties concerned harmless, meaning I will not sue if my failure to submit for a test or the results of my test prevent me from obtaining a job or continuing employment. This policy has been explained to me in a language I understand. I understand this is a legal binding document because American Personnel and Temps is paying for the examination.

I understand that American Personnel and Temps will require a drug screen test whenever an on the job accident or injury is reported in accordance with American Personnel and Temps policy and this authorization and consent. My refusal to submit to drug testing or a positive result for alcohol or any illegal substance will be grounds for termination.

I hereby authorize American Personnel and Temps to examine any and all criminal records and arrests on file in the counties in the State of Texas or any other state. In doing so, I understand that I am waiving my right of confidentiality concerning my criminal history.

ANTI HARASSMENT POLICY

American Personnel and Temps is firmly committed to a work environment free from all forms of harassment based upon protected status of any associate or applicant for employment by anyone, including supervisors, co-workers, clients/customers or visitors. Such harassment violates both American Personnel and Temps policy and state and federal discrimination laws. It is neither permitted nor condoned.

This policy prohibits any verbal, physical or visual conduct that belittles or demeans an individual on the basis of race, religion, national origin, sex, age or disability.

This policy specifically prohibits sexual harassment as well as all other forms of harassment.

Sexual harassment includes any unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature when:

1. Submission to such conduct is an explicit or implicit condition of employment;

2. Employment decisions are based on an associate’s submission to or rejection of such conduct; or

3. Such conduct unreasonably interferes with an individual’s work performance or creates an intimidating, hostile or offensive work environment.

Any associate or applicant for employment who feels that he or she has been harassed, sexually or otherwise, or knows of or suspects the occurrence of harassment is strongly urged and encouraged to contact his or her American Personnel and Temps Representative. If an associate feels uncomfortable about approaching his or her American Personnel and Temps Representative, the associate should contact any manager at his or her local American Personnel and Temps office. Any person making a harassment complaint may do so without fear of retaliation. American Personnel and Temps will discipline, including discharge, any person who engages in retaliatory activity against a person making a harassment complaint.

Because of the sensitivity of harassment issues, each case will be handled promptly and thoroughly investigated to determine whether the complained-of harassment has occurred. The investigation will be conducted in a confidential manner, to the extent consistent with the need to conduct a thorough and complete investigation.

Any associate found to have violated American Personnel and Temps’ policy against harassment will be subject to immediate disciplinary action, including written disciplinary warnings, transfer, demotion, suspension and/or discharge. By enforcing this policy, we will preserve the right of every associate and applicant for employment to enjoy a workplace free of harassment of any type.

Confidentiality Release

I hereby authorize American Personnel and Temps to release any and all information in my personnel file and/or information regarding my work status, background and drug test results to any client that I am assigned to.  I understand this includes written and verbal documentaion by both myself and American Personnel and Temps representatives.

In doing so, I understand that I am waiving my right of confidentiality in these areas.

EMPLOYEE AGREEMENT

In submitting this application for employment, I authorize investigation of my background, all statements contained herein, and it is understood and agreed that any misrepresentation (including omission of information) by me in this application will be sufficient cause for cancellation of the application and/or for separation from Company’s service if I have been employed. Upon written request, additional information as to the nature and scope of the investigation, if one is made, will be provided.

I understand that my employment with American Personnel and Temps is at will and can be ended as deemed necessary by American Personnel and Temps. No person has the authority to modify the at will statement except in writing and it must be authorized by the President of the company.

I have received and read and I understand the following about being an employee of American Personnel and Temps: 1) I have been informed and understand all policies and procedures; 2) I recognize that I am an American Personnel and Temps employee and agree to obtain permission from American Personnel and Temps for all absenteeism, call American Personnel and Temps if I am going to be late, and inform American Personnel and Temps if my supervisor discusses with me either permanent employment or a call back for an additional assignment; 3) I will give a one-week notice if I cannot complete my assignment; 4)failure to provide American Personnel and Temps with current phone numbers is ground for immediate termination; 5) I understand that it is my responsibility to call the available line (409) 813-2008 at American Personnel and Temps once per week and inform them of my availability. Failure to do so may be considered a voluntary quit and may affect my eligibility for unemployment compensation; 6) I agree never to accept employment with any customer or agency within 1 year, where American Personnel and Temps has employed me, without prior written approval from American Personnel and Temps. Should I accept such employment without written approval, I agree to pay an Employment Fee of 1% per thousand of my yearly estimated wage not to exceed 15% to American Personnel and Temps; 7) I understand that I must contact American Personnel and Temps on the last day of my assignment for future employment. Failure to do so may be considered a voluntary quit and may affect my eligibility for unemployment compensation.

AGREEMENT ADDENDUM

I do hereby understand and agree accordingly to American Personnel and Temps policy, once I have accepted an assignment then neglect to be present at the date and time agreed, or fail to complete my assignment as agreed, without first notifying American Personnel and Temps and staying at my assignment until my replacement arrives, I do hereby understand I will be terminated and no further work will be available for me through American Personnel and Temps.

I do hereby understand that it is my responsibility to call the available line (409) 813-2008 at American Personnel and Temps once per week and inform them of my availability. Failure to do so may be considered a voluntary quit and may affect my eligibility for unemployment compensation.
